These Terms and Conditions ("Terms") govern your use of the website at byproducts.timberage.com (the "Site"), operated by Timber Age Systems, Inc. ("we," "us," or "our"), and your purchase of Wood Byproducts (the "Products") offered for sale on the Site. By placing an order for Products, you agree to be bound by these Terms.

1. Products and Description

Our Products consist of wood byproducts such as wood chips, sawdust, shavings, cut-offs, and other residual materials from woodworking and milling operations.

• Product Variation: Due to the nature of wood byproducts, Products may vary in size, shape, species, moisture content, color, and consistency from any samples, descriptions, or images provided on the Site. All weights and measurements are approximate.

• Intended Use: The customer is solely responsible for determining the suitability of the Product for their intended use. We make no representations or warranties, express or implied, regarding the fitness of the Products for any particular purpose.

2. Pricing and Payment

• Pricing: All prices are listed in USD and are subject to change without notice. The price charged will be the price in effect at the time the order is placed.

• Taxes: Prices are inclusive of any applicable local, state, or federal taxes.

• Payment: We accept ACH and Credit Card payments. Payment must be received in full before an order is processed and prepared for pickup.

3. Order Acceptance and Cancellation

• Order Acceptance: Your receipt of an electronic or other form of order confirmation does not signify our final acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept or decline your order for any reason.

• Order Cancellation by Customer: Once an order has been placed, it cannot be canceled by the customer because processing, weighing, and packaging often begin immediately due to the nature of the bulk products.

• Order Cancellation by Us: We reserve the right to cancel any order for reasons including, but not limited to, product unavailability, errors in pricing or product description, or issues with payment verification. If we cancel your order, we will issue a full refund to your original method of payment.

4. Delivery & Loading

• Loading of Your Vehicle:  We do our best to provide great service and the use of our equipment to load your trailer or vehicle. We may ask for your help in the loading process. Any damage to your method of conveyance due to your negligence in directing our team members is your responsibility.

• Shipping Estimates: Any shipping or delivery dates provided are estimates only. We are not liable for any delays in shipping.

• Transfer of Risk: Risk of loss and title for all Products purchased pass to you upon our delivery to your vehicle or method of product conveyance (FOB Shipping Point). This means you are responsible for the product immediately upon loading of product into your vehicle, trailer, etc.

• Inspection: Upon receipt of your shipment, you must immediately inspect the exterior packaging and the contents for any damage. If the packaging appears damaged, you must address the issue with the TAS Team Member loading your product. Failure to note damage at the time of delivery may invalidate any future claim.

5. Non-Returnable and Non-Refundable Policy

Due to the bulk, weight, and nature of the Wood Byproducts, and the high cost of transportation and handling, all sales are final.

• No Returns: We do not accept returns for any reason, including but not limited to, dissatisfaction with product appearance, texture, size, moisture, or inconsistency.

• No Exchanges: We do not offer exchanges for any Products.

• No Refunds: We do not offer refunds once an order has been picked up, except in cases where we cancel the order before shipment (as per Section 3).

6. Disclaimer of Warranties and Limitation of Liability

• "AS IS" Basis: All Products are sold "AS IS," without any warranties, express or implied. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

• Limitation of Liability: Our liability for any Product purchased is strictly limited to the purchase price of that Product. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS, REVENUE, OR DATA) ARISING FROM THE USE OF THE PRODUCTS OR THE SITE.

7. Governing Law

These Terms and your use of the Site shall be governed by and construed in accordance with the laws of the State of The Great State of Colorado, without regard to its conflict of law principles.

8. Changes to Terms

We reserve the right to update or modify these Terms at any time without prior notice. The Terms in effect at the time of your order will govern that purchase.
